Definition

Each of the terms mentioned below have in these Conditions of Use of Procusmart Services (hereinafter the "Conditions") the following meanings:

Announcement: refers to all the elements and data (visual, textual, sound, photographs, drawings), presented by Bid Originators or Bidders.

Personal Account: refers to the free space than any Advertiser must create and which it should connect from the Website to disseminate, manage and view its ads.

Mediacarte (Pty) Ltd: means the company that publishes and operates Procusmart.

Services: Procusmart service means the services made available to Users, Bidders and Bid Originators on https://www.procusmart.com

Website: means the website operated by Procusmart accessed mainly from the URL https://www.procusmart.com and allowing Users, Bidders and Bid Originators to access Procusmart.

User: any visitor with access to Procusmart via the Website and Mobile Site accessible from different media.

Bidder: Any person or organization making use of the Procusmart and responding to a call, project, bid, RFQ, tender or offer.

Organization: Any moral entity or company making use of the Procusmart and submitting or responding to a call, project, bid, RFQ, tender or offer

Bid Originators: Any person or organization making use of the Procusmart, who is the owner of a call, project, bid, RFQ, tender or offer.

Commission: A set percentage of value involved paid to Procusmart for their services.

Subject

These Terms and Conditions of Use establish the contractual conditions applicable to any subscription by an Advertiser connected to its Personal Account from the Website and Mobile Site.

Acceptance

Any use of the website by Bidder and Procusmart is full acceptance of the current Terms.

Responsibility

Procusmart cannot be held liable for non-performance or improper performance of due control, either because of the Client, or a case of major force.

Modification of these terms

Procusmart reserves the right, at any time, to modify all or part of the Terms and Conditions. Clients and Project masters are advised to consult the Terms to be aware of the changes.

Miscellaneous

If part of the Terms should be illegal, invalid or unenforceable for any reason whatsoever, the provisions in question would be deemed unwritten, without questioning the validity of the remaining provisions will continue to apply between Clients, Project masters and Procusmart.
